Gift Card Helikon-Tex regulations
I. General provisions
§1
In these regulations of the Helikon-Tex gift card, hereinafter referred to as the “Regulations”, the following terms shall be understood as:
a. Publisher - Entire M sp. z o.o. with its registered office in Miękinia, ul. Zachodnia 9, Błonie, 55-530 Miękinia, registered in the Register of Entrepreneurs of the National Court Register under the number KRS 0000410970, whose registration files are kept by the District Court for Wrocław Fabryczna in Wrocław, VI Commercial Department of the National Court Register, share capital PLN 100,000, NIP 8943037908, REGON 021820847,
b. Gift Card - an electronic voucher in the form of a printed card, issued to the bearer, entitling the User to use it in the Helikon-Tex online store. The Gift Card is not an electronic payment instrument, electronic money instrument or payment card,
c. Customer - a person who purchases a Gift Card,
d. User - each holder of a Gift Card,
e. Online store - Helikon-Tex online store located on the website www.helikon-tex.com and its subpages,
f. Top-up Amount - top-up value of the Gift Card.
§2
1. The Regulations specify the conditions for issuing and using the Gift Card
2. Regulations are available:
a. at the Publisher's office;
b. at www.helikon-tex.com/en_eur/gift-cards
II. Issuing a Gift Card

1. The Gift Card is issued via the Helikon-Tex online store.
2. The condition for issuing a Gift Card to the Customer is its topping-up by the Customer, i.e. purchase via the Helikon-Tex online store.
§4
1. The Gift Card can only be used in the Helikon-Tex online store directly after issuing the Card to the Customer.
2. The Gift Card is valid for 12 months from the day of its issuing.
3. The Gift Card is for single use only. Funds not used during one purchase are forfeited and neither the User nor the Customer can withdraw the remaining funds.
4. The Publisher may carry out and cancel promotional campaigns, consisting in particular of issuing Gift Cards with a validity period other than that specified in point 2 of this paragraph. This does not affect the expiry date of previously issued Gift Cards.
III. Rules for using the Gift Card
§5
1. The Top-up Amount is a prepayment for future purchases made by the User in the Helikon-Tex online store.
2. The Gift Card entitles its User to pay for goods offered in the Helikon-Tex online store.
3. In the Helikon-Tex online store, the User carries out the Gift Card by entering the Gift Card number in the appropriate field before placing the order ("Enter the discount code" field).
4. The User may use the Gift Card once.
5. The value of purchases made using the Gift Card cannot be equal to or lower than the value of the Gift Card
6. The User is obliged to pay the difference between the price and the value of the Gift Card via one of the payment methods available in the store www.helikon-tex.com.
§6
1. The publisher will refuse to process the order using the Gift Card if:
a. the Gift Card used by the User is not authentic;
b. the User has no funds on the Gift Card;
c. there appears a lack of sufficient funds on the Gift Card enabling the purchase of the goods selected by the User, in a situation where the User refuses or is not able to pay the missing part of the price at the moment as described in §5 point 6.;
d. the User attempts to make purchases equal to or lower than the value of the Gift Card;
e. the Gift Card expires.
2. In the event of a permanent lack of technical feasibility of a Gift Card, the Publisher will pay the User the amount corresponding to the current value of the Gift Card.
§7
1. Cash accumulated on the Gift Card is not subject to interest and, subject to §6 point 2., is not refundable to the Customer or User. In particular, the Gift Card cannot be exchanged for cash, in whole or in part, and cannot be returned to the Publisher or exchanged for other cards or vouchers issued by the Publisher.
2. The value of the Gift Cards Top-up Amount is printed directly on it.
IV. Return of goods
§8
1. Goods purchased in the Helikon-Tex online store using the Gift Card are subject to return under general principles provided for by law or additionally accepted in the Helikon-Tex online store.
2. If the User returns goods purchased using a Gift Card, the refund is made to a new Gift Card equal to the value of the returned goods.
V. Liability and complaints regulations regarding the Gift Card
§9
1. Complaints regarding the issue, top-up and use of the Gift Card may be submitted directly in the Helikon-Tex online store, by post to the address of the publisher's office indicated in §1 point a., with the note "Gift Card - complaint" or by e-mail to the following address: [email protected].
2. The complaint should include the contact details of the person submitting the complaint, enabling the answer, and a description of the event underlying the complaint.
3. The publisher will respond to the complaint within 14 days from the date of receipt.
4. For all matters not regulated in the Regulations, including the processing of personal data of the Customer and the User, the provisions of the Regulations of the Online store will apply.
